General Terms and Conditions of Use, Access, Cookies and Data Protection

Acceptance

These General Conditions regulate the access and proper use of the Web of Virtual doctor and Medicines S.L. – VDM Health in the url https://www.vrdocmed.com , and of the APP PHARMA published in the Web https://pharma.vrdocmed.com/ (hereinafter indistinctly “the APP”, “APP PHARMA” or “the Web”), belonging to the family of products and applications for digital health called “VR Medicines” of Virtual Doctor and Medicines, S.L. (hereinafter also “VDM Health” or “The Company”).
APP PHARMA is an informative help tool of the drugs marketed in Spain for the exclusive use of the doctor and healthcare professional in this country, and includes the most relevant information, duly structured, consolidated, filtered and coded, of all drugs and active ingredients authorized for use and marketing in Spain by the Spanish Agency for Medicines and Health Products (AEMPS) and the European Medicines Agency (EMA). In particular, it shows the drug information of most interest to the medical practitioner, such as indications, uses, contraindications, posology, interactions, allergies, precautions, warnings and possible adverse effects, as referred to in the information supplied by the manufacturing laboratories themselves for use in Spain.

Purpose

The materials and contents included in the APP PHARMA and its Web are built from the information from the technical data sheets of the manufacturers of the drugs authorized in Spain, who are the guarantors and responsible for the use made of each of them, and are provided solely and exclusively to doctors and health professionals for purely informational purposes, leaving to each of them the decisions they take in prescribing the drugs they decide for their patients.
Our APP PHARMA and our Web do not intend in any way to influence or participate in any way in the decision making of doctors and health professionals in front of their patients, nor directly or indirectly influence in any way in the health status of patients.
Our APP PHARMA and our website do not intend to offer recommendations or provide information to be used for decision making for therapeutic or diagnostic purposes, both of which remain in the hands of doctors and health professionals, who are the ones who prescribe drugs and medicines to their patients. It acts as a mere resource and complement to inform about all the characteristics and knowledge of the drugs on the market for medical practitioners, who are the ones who will make their own decisions when prescribing drugs to their patients, without our APP PHARMA or our Web participating in it.

Restrictions on use

The use of the PHARMA APP is granted under commercial license to authorized users who have contracted the same with the Company, and allows its access, use and employment with the limits and conditions of such license.
It is not permitted under any pretext to access, use and use the PHARMA APP without having such contracted commercial license, nor is it permitted in any case, whether or not with a contracted license, to copy, download, print, extract or appropriate in any possible way, in whole or in part, the texts, images, designs, screens, information, materials, content and responses of the PHARMA APP.
Commercial use, distribution or public display, transformation or decompilation of the contents of the PHARMA APP is expressly prohibited.

Disclaimer of Liability.

Virtual Doctor and Medicines, S.L. is expressly exempted from any liability, warranty rights and legal obligations of any kind to users of the PHARMA APP and third parties arising and produced as a result of errors or omissions that may occur with respect to the accuracy, suitability, validity, validity, validity, transcription, transcription, and in general of all the information contained and supplied by the APP PHARMA and the Web, being consequently expressly excluded from the obligation to indemnify, repair or respond for damages that may occur directly or indirectly for this reason.

All users of the PHARMA APP and the Web are expressly warned of the exoneration regime of responsibilities and damages established for Virtual Doctor and Medicines, S.L. in the preceding paragraphs, which they expressly accept in advance and without reservation of any kind, without prejudice to the responsibilities that individually correspond to each of them for the use, use, purpose or destination of the information they extract from the PHARMA APP and the Web, added to the responsibility that corresponds to the manufacturers of the drugs and medicines that are marketed in Spain for the information that each one of them publishes in their respective technical data sheets authorized by the AEMPS and the EMA, from which the PHARMA APP is nourished.

VR Medicines has a purely informative character addressed to the medical professional, and therefore does not intend to diagnose patients, prescribe drugs or recommend therapies of any kind. It acts as a mere resource and complement to inform and support doctors in the prescription of medicines, and in no way intends to replace them in this task. Likewise, authorized users must have the necessary knowledge to be able to know, consult and properly interpret the information provided by VR Medicines, expressly exempting Virtual Doctor and Medicines, S.L. from any obligation and responsibility for the authorized use they make of APP PHARMA, and in particular in the work of prescription and electronic prescription.

Geographical Scope

The information on drugs and medicines displayed by APP PHARMA refers to those that are authorized and marketed in Spain in accordance with the decisions of the AEMPS and the European Medicines Agency (EMA).

Therefore, some of the drugs and medicines shown by the APP PHARMA may not be available in the country through which you are accessing, if different from Spain, or, if available, the information shown for them may be different from that indicated in the technical data sheets of the laboratories for your country.
Accesses and changes in the APP and the Website
The Company reserves the right to modify, at any time and without prior notice, the design, configuration, texts, images or the general or particular conditions applicable to the PHARMA APP and its Website, and may temporarily or permanently interrupt, due to technological needs and according to its good judgment, at any time, without prior notice, the access, use and employment of the same, saving the rights that correspond to the registered users who are authorized under a contracted license and in force.

Intellectual Property

The PHARMA APP and the Web is the sole and exclusive property of Virtual Doctor and Medicines, S.L., who holds all copyrights, use and exploitation of the same against users and third parties worldwide.
The property rights cover all the manifestations by the use and use of the APP PHARMA® and the Web, and in particular, of the texts, images, designs, screens, information, materials, contents and answers of the APP PHARMA® and the Web.

APP PHARMA® and VRMedicines® are registered trademarks.

All the material, contents, electronic files, screens, designs, programming, source codes and other elements that make up the APP PHARMA and the Web are deposited notarially, by means of which the Company may practice the rights of accreditation, opposition and request the precautionary measures allowed by the Spanish Intellectual Property Law, the Berne Convention for the Protection of Literary and Artistic Works, and the WIPO Copyright Treaty.

Prohibitions

Unauthorized use of all or part of the PHARMA APP and the Website, as well as its reproduction, copying, transmission or storage in whole or in part by any means or in any place, except as permitted in these general conditions or by law, is prohibited.
It is expressly prohibited the total or partial use of the PHARMA APP and the Web for the creation by third parties of electronic databases, materials, images, designs, screens, contents, codifications, filters, responses and processes similar to those offered by both products of the Company, as well as any development by third parties aimed at the total or partial appropriation, exploitation, piracy and plagiarism of the PHARMA APP and the Web.
The creation of links to the Website is permitted, provided that they are to the home page. Deep links to other pages (“deep link”), framing and any other unauthorized use or any other use aimed at infringing the intellectual property rights and authorship of the Company are expressly prohibited. In this sense, those who wish to establish a link or hyperlink between their Web page and the PHARMA APP Web, must obtain the express written authorization of the Company, without this implying a contractual relationship between the Company and the owner of the page in which the link is established, nor the approval or acceptance by the Company of the use of the PHARMA APP, which may only be granted through the contracting of a license.
The total or partial incorporation of the content and processes executed by the PHARMA APP into any other work, Web or content, whether in paper or electronic format, is not permitted. In particular, no part of the contents, images, designs, materials, results and processes executed by APP PHARMA may be copied or distributed in any form by any third party for any reason whatsoever, including, obviously, for commercial purposes or with the intention of copying or appropriating the processes and knowledge of the drugs provided by APP PHARMA.

Warranty

Visitors use the PHARMA APP and the Website at their own risk. Both APP PHARMA and Web are provided “as is”, without any other warranty or guarantee in favor of the user, express or implied. The Company accordingly declines to grant any warranty rights to registered users and third parties with respect to the PHARMA APP and the Website, nor to any other third party to which it may link its contents and processes, including any information, material or other content, express or implied.
The Company refuses to grant the registered user any warranty for malfunction of the PHARMA APP application, the Web site browser, viruses, incompatibilities and problems of their respective operating systems, or any other cause or functional problem that could have caused any damage to the user or prevent the correct execution of the PHARMA APP contracted.
The PHARMA APP and the Web may contain links to other Web sites. The Company does not offer any guarantee to users regarding the operation and suitability of these links.
Under no circumstances will the Company be held responsible for services or websites of third parties.
Responsibilities for the use of the applications
The Company, its employees, collaborators or contractors shall not be liable for any damage, harm or any other consequence that may arise from access to or use of the PHARMA APP and the Website by registered users, nor shall it be liable for any security errors that may arise from access to and use of the applications, nor for any damage that may be caused to the user’s computer system (hardware and software), as well as the files or documents stored therein.

Privacy Policy

In accordance with the current regulations on personal data protection, Virtual Doctor and Medicines, S.L. informs users that their personal data transmitted to complete the registration forms of the PHARMA APP and the Web, will be stored in an electronic file created and maintained for this purpose by the Company and registered with the Data Protection Agency. The Company may process this information both to respond to your requests for information and to send you, by any means, including e-mail, information about products and services that the Company considers may be of interest to the user.
For these purposes, the user expressly authorizes the sending of commercial information by e-mail.
The Company understands that the data provided are confidential, and will use all technical and human resources to prevent unauthorized access, as well as any alteration or loss of data. The personal data provided will not be transferred to third parties under any circumstances or pretext.

Use and treatment of Cookies

The Web uses cookies in the user’s navigation through its web page.
